These Terms of Service (“Terms”) constitute a legally binding agreement between you (“you,” “your,” or “User”) and NFCBlanks.com (operated by NFCB, “we,” “us,” or “our”), concerning your access to and use of our website https://www.nfcblanks.com, any associated mobile applications, dashboards, APIs, NFC/phygital products, blockchain-integrated services, authentication tools, and any other related services (collectively, the “Services”).

By accessing, browsing, or using the Services, or by clicking to accept or agree to these Terms when prompted, you agree to be bound by these Terms and our Privacy Policy (incorporated herein by reference). If you do not agree, do not access or use the Services.

These Terms apply to all visitors, users, customers, brands, and others who access or use the Services.

1. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Services. By using the Services, you represent and warrant that you meet this requirement and have the legal capacity to enter into these Terms.

To access certain features (e.g., purchasing NFC tags/products, using the dashboard, managing phygital experiences or blockchain authentication), you may need to create an account. You agree to provide accurate, current, and complete information and to update it as necessary.

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us immediately of any unauthorized use.

We reserve the right to suspend or terminate accounts for violations of these Terms.

3. Products and Orders

We offer NFC-enabled tags, stickers, labels, clothing integrations, phygital products, blockchain authentication services, dashboards, and related items.

  • Orders: Placing an order constitutes an offer to purchase. We may accept or reject orders at our discretion. Prices and availability are subject to change.
  • Payment: Payments are processed through third-party providers. We do not store full payment card details. You authorize us (or our processor) to charge the selected payment method.
  • Shipping and Delivery: Shipping terms, times, and costs are as stated at checkout or on our site. Risk of loss passes upon delivery to the carrier (or as specified).
  • Taxes: You are responsible for any applicable taxes, duties, or fees.
  • Returns/Refunds: Subject to our Return and Refund Policy (linked or stated separately). For California consumers, note that if our return policy includes any non-standard requirements, it will be clearly posted per California Civil Code § 1723.

4. Use of Services

You agree to use the Services only for lawful purposes and in accordance with these Terms. Prohibited uses include:

  • Misusing NFC interactions, dashboards, or blockchain features (e.g., tampering with tags, falsifying scans, or unauthorized data access).

For brands using our platform: You represent that any phygital experiences, linked content, or blockchain data comply with applicable laws and do not infringe third-party rights.

5. Intellectual Property

All content on the Services (text, graphics, logos, software, designs) is owned by us or our licensors and protected by copyright, trademark, and other laws.

We grant you a limited, non-exclusive, non-transferable license to access and use the Services for personal or internal business purposes (as applicable), subject to these Terms.

You retain ownership of any content you upload or provide (e.g., custom designs for tags), but grant us a worldwide, royalty-free license to use, host, display, and distribute it as necessary to provide the Services.

For NFC/phygital products: Ownership of physical items transfers upon delivery; digital elements (e.g., linked blockchain data, experiences) may be licensed per product terms. We do not transfer ownership of underlying software, blockchain protocols, or platform features.

6. User Content and Conduct

You are responsible for any content you submit or generate via the Services. We may remove content that violates these Terms.

7. Third-Party Links and Services

The Services may link to or integrate with third-party sites/services (e.g., payment processors, blockchain networks). We are not responsible for their content, practices, or availability.

8. Disclaimers

THE SERVICES AND PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that the Services will be uninterrupted, error-free, secure, or virus-free. NFC interactions, blockchain features, and phygital experiences depend on external factors (e.g., device compatibility, network conditions, blockchain protocols) beyond our control.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, DATA LOSS, OR BUSINESS INTERRUPTION, EVEN IF ADVISED OF THE POSSIBILITY.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify, defend, and hold us harmless from claims arising from your use of the Services, violation of these Terms, or infringement of third-party rights.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of California, without regard to conflict of laws principles.

Any disputes shall be resolved exclusively in the state or federal courts located in Los Angeles County, California. You consent to the personal jurisdiction of such courts.

For California residents: These Terms comply with applicable California consumer protection laws (e.g., no misleading terms regarding digital elements per relevant statutes).

12. Termination

We may terminate or suspend your access at any time for violations or at our discretion.

13. Changes to Terms

We may update these Terms. Changes will be posted with a new effective date. Continued use constitutes acceptance.

14. Miscellaneous

  • Entire Agreement: These Terms (with Privacy Policy) constitute the entire agreement.
  • Severability: Invalid provisions do not affect the remainder.
  • No Waiver: Failure to enforce does not waive rights.
  • Assignment: We may assign these Terms; you may not without consent.
  • Force Majeure: Not liable for events beyond control.
